Terms of service

  • Must be 18 years and up to agree to my TOS.

  • Commissions such as illustrations are for personal use only. These can be used as profile pictures and banners, but cannot be used for profit. If the work is being used as merch, there will be an additional commercial fee.

  • Live 2D models have their commercial cost is factored into the pricing by default. +20%)

  • Clients or Customers do not have the right to use or sell their purchase as NFTs or use through AI generation.

  • Must credit the artist (Phocus/P.O.Y.) when posting commissioned or purchased work.

  • For models created by P.O.Y. (Phocus), or commissions that are made public by the client, have the ability to be posted to my alternate social media platforms. Commissions will include all credit towards the client for ownership of the work.

  • Information of the client or customer must be provided when purchasing or commissioning from P.O.Y. (Phocus). An email and socials must be provided, and respectfully any miscellaneous information that you would like to provide would be appreciated.

  • A complete reference of the character being commissioned is required. Not providing ALL details can cause confusion and delay work time. (For commissioned works.)

  • All work that is produced is copyrighted under P.O.Y. (Phocus).

  • Phocus/P.O.Y. reserves the right to deny or cancel any projects if necessary (For commissioned works.)

Payment

  • Projects will not start unless 1/4 (for models) or 1/2 (for illustrations) of the payment has been made through invoice. (For commissioned works.)

  • All payments are made through PayPal invoices. (USD only. Other methods may be available in the future.)

  • Additional fees may be applied for commissioned work. (Commercial fee for Live 2D Models are already calculated.)
